Rental Rage Relief

Can my landlord just cancel my lease?

Many tenants over the years, and especially approaching the holiday season, are given notice to vacate their homes before the lease agreement naturally/legally ends. Our case experience has often led to a reason that landlords terminate a lease prematurely.

There is a shortage of rental holiday stock on the market in the Western Cape, especially the coastal and winelands regions. This shortage of stock in the market drives rental market prices higher.

Landlords realize that they can earn a higher return when comparing the market related rentals on various property websites.

There may be many influencing factors involved in a landlord’s decision to terminate a lease agreement, but is it legal?

Laws that govern the property industry are publicly available. New laws related to the rental industry and consumer rights are updated periodically.

The relevant acts that govern the property industry, in relation to tenants and landlords are, the P.I.E Act, the Rental Housing Act, the Consumer Protection Act and the Unfair Business Trade Act.

Cases referred to our courts or tribunals are taken on individually, with all available documentation related to the circumstances that have lead the tenant or landlord seeking arbitration or ruling.

Seek advice from a property professional before engaging in expensive and time consuming legal relief.
