A quick guide to rental property rules for landlords & tenants


For Landlords:


  • Lease Agreement:

  • A written agreement with clear terms.

  • Include duration, rent, escalation clauses, maintenance responsibilities, deposits, and renewal/termination conditions.

  • Deposit Management:

  • Collect and deposit security in an interest-bearing account.

  • Provide proof of deposit to the tenant.

  • Return deposit with interest, minus damages, within 14 days post-lease.

  • Property Inspection:

  • Joint pre-move-in inspection with the tenant.

  • Document and sign off on property condition.

  • Conduct final inspection at move-out.

  • Maintenance and Repairs:

  • Ensure the property is habitable and safe.

  • Promptly address repairs and maintenance.

  • Keep maintenance records.

  • Rental Increases:

  • Provide two months' written notice.

  • Ensure increases are fair and market-aligned.

  • Termination of Lease:

  • Follow correct termination procedures.

  • Provide adequate notice and clear reasons.

  • Communication:

  • Maintain open, clear communication.

  • Keep records of all written interactions.

  • Legal Compliance:

  • Comply with the Rental Housing Act and municipal bylaws.

  • Stay updated on legal changes.


For Tenants:


  • Lease Agreement:

  • Read and understand before signing.

  • Ensure terms are clear.

  • Keep a copy of the signed lease.

  • Deposit Management:

  • Pay the deposit as agreed, and request proof of interest-bearing account.

  • Understand deposit withholding conditions.

  • Property Inspection:

  • Participate in joint inspection and document condition.

  • Sign and keep a copy of the inspection report.

  • Maintenance and Repairs:

  • Report issues in writing promptly.

  • Keep records of maintenance requests.

  • Maintain property, and avoid intentional damage.

  • Rental Payments:

  • Pay rent on time, and keep payment records.

  • Communicate financial difficulties early.

  • Lease Termination:

  • Provide written termination notice per agreement.

  • Ensure the property is in good condition, and attend final inspection.

  • Rights and Responsibilities:

  • Understand rights and duties under the Rental Housing Act.

  • Know dispute resolution procedures.

  • Communication:

  • Maintain open communication with the landlord.

  • Keep records of all interactions.
