Following legal process in rentals;
The importance of understanding the legal responsibilities, between a landlord and tenant, in a lease agreement is crucial. The agreement must be in plain/understandable
language, if you’re not sure, ask.
The basic responsibilities between tenants and landlords are;
-A property owner provides a service in renting a suitable home for a fee/rent.
-A tenant rents the property after agreeing to the terms and conditions.
-The owner is responsible for maintaining the structure and services.
-The tenant is responsible for the upkeep/maintenance of the garden and interior.
Where both parties need to be careful is the “fine print”, or legally binding clauses that seem innocuous at first but carry legally binding responsibilities. Most all lease agreements are created by lawyers, with a fine understanding of the laws that govern the industry.
The process to follow in dispute;
-A signed lease agreement is binding and accepted in courts of law.
-All communication between aggrieved parties must be in writing, electronic is acceptable.
-Follow the process of “breach of contract” clause in the lease to send a notice.
-Information is readily available on the net to gain a better legal understanding of your dispute.
